Terms and Conditions power-cube.pl Online Store

  1. General Provisions and Seller Contact Details
    1. These Terms and Conditions (the “Terms and Conditions”) govern the use of the power-cube.pl online store available at https://www.power-cube.pl (the “Store”).
    2. The Store is owned and operated by Maciej Majchrzak, conducting business under the name Allocacoc Polska Check It Group Maciej Majchrzak, with its registered address at os. Pod Lipami 104/22, 61-640 Poznań, Poland, entered in the Polish Central Register and Information on Economic Activity (CEIDG), Tax Identification Number (NIP): 7792026058, REGON: 361836227 (the “Seller”).
    3. The Seller can be contacted using the following details:

  2. Technical Requirements
    1. To use the Store, the Customer must have:
      1. a computer, smartphone or other device equipped with a web browser;
      2. access to the Internet;
      3. an active e-mail address.
  3. Personal Data
    1. The Seller is the controller of the personal data of the Store's Customers.
    2. Detailed information concerning the processing of personal data of Customers and other users of the Store is available in the Privacy Policy .
  4. Placing Orders, Conclusion of the Sales Contract and Customer Account
    1. The Store allows Customers to purchase goods offered on the Store's website (the “Goods”):
      1. without creating a Customer Account; or
      2. by creating and using a Customer Account.
      In either case, in order to place an order, the Customer must select the Goods, add them to the shopping cart and proceed through the checkout process, including selecting the available delivery and payment methods.
    2. Product information displayed in the Store, including product descriptions and prices, constitutes an invitation to enter into a contract within the meaning of Article 71 of the Polish Civil Code and does not constitute a binding offer by the Seller.
    3. To place an order, the Customer must provide all information marked as required and necessary for the performance of the Contract. Where requested by the Customer, the Customer must also provide the information required for issuing a VAT invoice.
    4. If the Customer chooses to create an account in the Store (the “Account”), registration is completed once. The e-mail address and password selected by the Customer are subsequently used to access the Account. The detailed terms governing the Account service are set out in the Account Terms and Conditions below. The Store may also allow Customers to sign in using social media services and/or a Google account. Once logged in, the Customer can access their order history and may place subsequent orders without having to enter the same personal information again.
    5. The Customer may close their Account at any time and free of charge by sending a request to sklep@power-cube.pl.
    6. By clicking the “Buy and Pay” button, or another button with equivalent wording, the Customer:
      1. submits an offer to purchase the selected Goods from the Seller in accordance with the order details and these Terms and Conditions; and
      2. acknowledges and accepts the obligation to pay the price of the Goods together with any applicable delivery charges.
    7. The sales contract (the “Contract”) is concluded when the Seller accepts the Customer's order for fulfilment. The Seller will confirm acceptance of the order by e-mail.
    8. If the Seller is unable to fulfil an order in whole or in part, the Seller will inform the Customer accordingly. In such circumstances, no Contract will be concluded in respect of the Goods that cannot be supplied. Where appropriate, the Seller may offer an alternative solution, including partial fulfilment of the order or waiting until the Goods are back in stock. If the Customer has already paid for Goods that cannot be supplied, the Seller will promptly refund the corresponding amount.
    9. The Seller will provide the Customer with confirmation of the Contract on a durable medium no later than upon delivery of the Goods.
    10. The Seller is not responsible for failure to deliver an order or for delays caused by the Customer providing an incorrect or incomplete delivery address or failing to provide information necessary to fulfil the order.
    11. The Seller reserves the right to suspend fulfilment of an order if the Customer has provided false information or if there are reasonable grounds to question the accuracy of the information provided. Where possible, the Seller will attempt to contact the Customer in order to verify the relevant information.
  5. Prices and Payment Methods
    1. Prices of Goods are displayed in Polish zloty (PLN) and are gross prices, inclusive of VAT where applicable.
    2. Delivery charges are shown separately during checkout and depend on the delivery method selected by the Customer.
    3. The payment methods currently available are listed in the “Payment Methods” section of the Store and are displayed to the Customer during checkout.
    4. The Store may offer the following payment methods:
      1. traditional bank transfer to the Seller's bank account;
      2. instant electronic bank transfer, BLIK or digital wallet payments via payment service providers including:
        • Shoper Payments (Autopay);
        • PayPal;
        • PayU;
        • Przelewy24;
        • Klarna.
      3. payment by Visa, Visa Electron, Mastercard or Mastercard Electronic;
      4. cash on delivery, where available;
      5. deferred payment through a payment provider indicated during checkout.
    5. If the Customer chooses to pay by traditional bank transfer, payment must be made within 7 days of placing the order. If payment is not received within this period, the Contract will be deemed not to have been concluded. This provision does not apply where the Seller offers deferred payment or instalment payment through an external payment provider.
    6. Where the Customer selects Shoper Payments, online payment processing services for instant bank transfers and payment cards are provided by Autopay S.A.
  6. Delivery
    1. Depending on the options available for a particular order, Goods may be delivered:
      • by courier; or
      • to an InPost parcel locker.
    2. Except where the Goods are collected personally by the Customer, the Seller considers an order to have been dispatched once the shipment has been handed over to the professional carrier responsible for delivery. The actual delivery time is determined by the carrier.
    3. The Seller normally dispatches Goods within 1 business day, unless a different dispatch period is expressly stated on the relevant product page at the time the order is placed. More detailed information is available in the “Order Processing Time” section of the Store.
    4. The Seller normally fulfils orders within the territory of the Republic of Poland at the delivery rates stated in the “Delivery Times and Costs” section of the Store. International delivery is also available where offered by the Store, subject to the delivery charges displayed on the Store's website or individually agreed with the Customer.
  7. Right of Withdrawal
    1. A Customer who is a consumer or an entrepreneur referred to in Article 7aa of the Polish Consumer Rights Act (the “Privileged Entrepreneur”) has the statutory right to withdraw from a Contract for the sale of Goods within 14 days of receiving the Goods, without giving any reason, subject to the exceptions set out below.
    2. To meet the withdrawal deadline, it is sufficient for the Customer to send a clear statement of withdrawal before the 14-day period expires:
      • by e-mail to sklep@power-cube.pl; or
      • in writing to Poznańska 5B, 62-081 Przeźmierowo, Poland.
    3. The Customer may use the model withdrawal form available here, but use of this form is not mandatory. The Seller will promptly acknowledge receipt of an electronic withdrawal notice by e-mail.
    4. Following withdrawal, the Customer must return the Goods at their own expense within 14 days to: Poznańska 5B, 62-081 Przeźmierowo, Poland.
    5. The Seller will refund the Customer without undue delay and no later than 14 days after receiving the notice of withdrawal. The refund will include:
      • the price paid for the Goods; and
      • the cost of the original delivery of the Goods to the Customer, up to the cost of the least expensive standard delivery method offered by the Store.
    6. The Seller may withhold the refund until the returned Goods have been received or until the Customer provides evidence that the Goods have been sent back, whichever occurs first.
    7. Unless the Customer expressly agrees otherwise, the refund will be made using the same payment method used for the original transaction.
    8. The Customer is liable for any reduction in the value of the Goods resulting from handling the Goods beyond what is necessary to establish their nature, characteristics and functioning.
  8. Exceptions to the Right of Withdrawal
    1. The statutory right of withdrawal does not apply to Contracts for the supply of Goods:
      1. which are made to the Customer's specifications, are non-prefabricated or are clearly personalised;
      2. which are liable to deteriorate or expire rapidly;
      3. which are supplied in sealed packaging and are not suitable for return for health protection or hygiene reasons once the packaging has been opened;
      4. consisting of sealed audio or video recordings or computer software supplied on a tangible medium, where the seal has been broken after delivery;
      5. which, after delivery, become inseparably mixed or combined with other goods due to their nature;
      6. consisting of newspapers, periodicals or magazines, with the exception of subscription contracts;
      7. whose price depends on fluctuations in the financial market which are beyond the Seller's control and which may occur before the withdrawal period expires;
      8. consisting of alcoholic beverages whose price was agreed when the Contract was concluded, where delivery may only take place after 30 days and whose value depends on market fluctuations beyond the Seller's control.
  9. Complaints and Non-Conformity of Goods
    1. The Seller is obliged to supply Goods that conform to the Contract.
    2. In relation to Consumers and Privileged Entrepreneurs, the Seller is liable for the conformity of the Goods with the Contract in accordance with the Polish Consumer Rights Act. In relation to other Customers, the Seller's liability is governed by the relevant provisions of the Polish Civil Code.
    3. Complaints may be submitted:
      • by e-mail to sklep@power-cube.pl; or
      • in writing to Poznańska 5B, 62-081 Przeźmierowo, Poland.
    4. The Seller will respond to the complaint in the same form in which it was submitted, i.e. in writing or by e-mail, within 14 days of receiving the complaint.
    5. If a Consumer or Privileged Entrepreneur is dissatisfied with the way in which a complaint has been handled, they may use available out-of-court consumer dispute resolution procedures, independently of their right to bring proceedings before a competent court.
    6. Depending on the circumstances, the Customer may in particular:
      1. apply to the competent Provincial Inspector of the Trade Inspection Authority (Wojewódzki Inspektorat Inspekcji Handlowej) for mediation aimed at resolving the dispute amicably;
      2. seek assistance from a district or municipal consumer ombudsman or from a consumer protection organisation;
      3. apply to a permanent consumer arbitration court for resolution of a dispute arising from the Contract;
      4. use the information on consumer dispute resolution bodies and other consumer redress mechanisms made available by the European Commission and the competent national authorities.
    7. Further information concerning out-of-court consumer dispute resolution procedures in Poland is available on the website of the Polish Office of Competition and Consumer Protection (UOKiK): https://polubowne.uokik.gov.pl/ .
  10. Final Provisions
    1. Contracts concluded through the Store are governed by Polish law. The Contract is concluded in the Polish language.
    2. Nothing in these Terms and Conditions excludes or limits any mandatory statutory rights available to Consumers or Privileged Entrepreneurs under applicable law.
    3. The Seller may amend these Terms and Conditions at any time. Any amendments will apply to orders placed after the revised Terms and Conditions have been published. In the case of previously concluded agreements for the provision of digital or electronic services and Customers who maintain an Account in the Store, the Customer will be informed of the amendment and of their right not to accept the amended Terms and Conditions.
    4. These Terms and Conditions are effective from 16 January 2025.

Account Terms and Conditions for the power-cube.pl Online Store

  1. General Provisions and Seller Contact Details
    1. These Account Terms and Conditions (the “Account Terms”) govern the use of the Customer account (the “Account”) available through the power-cube.pl online store (the “Store”).
    2. The Account Terms constitute terms and conditions for the provision of an electronic service within the meaning of the Polish Act on the Provision of Electronic Services. The Account service is an ancillary service provided in connection with the Seller's principal business activity of offering Goods for sale through the Store. The Account service is provided free of charge.
    3. These Account Terms supplement the Store Terms and Conditions. In matters not expressly regulated by the Account Terms, the Store Terms and Conditions apply.

  2. Technical Requirements and Account Functionality
    1. The technical requirements for using the Account are the same as those applicable to the Store and are specified in Section II.1 of the Store Terms and Conditions.
    2. By using an Account, the Customer may:
      1. save and store personal information, including the delivery address, so that the Customer does not need to enter the same information again when placing subsequent orders;
      2. access their order history; and
      3. check the fulfilment status of their orders.
  3. Account Service Agreement, Right of Withdrawal and Closing an Account
    1. Creating an Account results in the conclusion of an agreement for the provision of an electronic service for an indefinite period. The Customer may close their Account at any time, without giving any reason and without incurring any charges, by contacting the Seller at sklep@power-cube.pl. The Customer also has a statutory right to withdraw from the agreement for provision of the Account service within 14 days of its conclusion.
  4. Complaints
    1. In relation to Consumers and Privileged Entrepreneurs, the Seller is liable for conformity of the Account service with the agreement in accordance with the Polish Consumer Rights Act. In relation to other Customers, the Seller's liability is governed by the relevant provisions of the Polish Civil Code.
    2. Complaints concerning the Account service may be submitted to the Seller in accordance with the procedure set out in Sections IX.3–5 of the Store Terms and Conditions.
    3. If a Customer is dissatisfied with the way in which a complaint concerning the Account service has been handled, the available out-of-court dispute resolution procedures referred to in Sections IX.6–7 of the Store Terms and Conditions may also be used.
  5. Personal Data
    1. Detailed information concerning the processing of Customers' personal data, including processing in connection with the operation of the Account, is available in the Store's Privacy Policy.
  6. Amendments to the Account Terms
    1. The Seller may amend these Account Terms in accordance with the rules set out in Section X.3 of the Store Terms and Conditions. If the Customer does not accept the amended Account Terms, the Customer may terminate the agreement for provision of the Account service by contacting the Seller electronically, subject to a 14-day notice period.
